The Mental Capacity Act 2005 gives statutory force to the common law principle that all adults are assumed to have capacity to make decisions unless proven otherwise. In accord with best practice, this principle places the evidential burden on researchers rather than participants and requires researchers to take account of short-term and transient understandings common among some research populations. The aim of this paper is to explore some of the implications of the MCA 2005 for researchers working with 'vulnerable' populations (...) in health and social care settings. The Cyclical Consent Model is described and offered as a process by which researchers might develop good practice when engaged in research involving vulnerable people. (shrink)

This book presents the theory of capital utilization, a discussion of the econometrics of capital utilization, and econometric tests of the theory using international data. Capital utilization, defined as the proportion of time that capital is working productively, is mainly affected by shift-working. Capital utilization is an important economic variable that has received serious attention from economists only since the mid-1960s In the first part, the authors provide a synthesis of current knowledge, combining a consistent statement of existing theory with (...) some major extensions. In the second part, they turn to the econometrics, first discussing the appropriate methodology and then testing the theory on data from several countries. This empirical work is considerably more sophisticated than previous studies on this topic. Having established the theory and tested it, they move on to consider policy, the relationship between capital utilization and economic growth, and the place of shift-work in the dual economy. This article seeks to clarify the relation between arguments for atheism and descriptions of the summum bonum in Indian Buddhism, through the analysis of one influential text. I begin by noting that a number of writers have detected a tension between, on the one hand, Buddhist refutations of the existence of “God” (īśvara, ātman, puruşa) and, on the other, Buddhist (especially Mahāyāna) claims about the nature of the ultimate (nirvāna, buddha, dharmakāya), which often appears to have God-like qualities. I then (...) turn to a locus classicus of Mahāyāna Buddhist philosophy of religion, the Pramānasiddhi (“Establishment of Authority”) chapter of the Pramānāvarttika (“Commentary on Authority”) of Dharmakīrti (7th century CE). After briefly introducing Dharmakīrti and the Pramānasiddhi chapter, I examine first the chapter’s atheological passages, which include a systematic attack on a Hindu (Nyāya) “argument from design” and a number of important claims about the implausibility of any permanent “spiritual” principle. The arguments are complex and varied, but most turn on the crucial Buddhist assumption that a permanent entity is by definition incapable of interaction with the impermanent, hence utterly unsuitable as a cause or effect. I then examine the chapter’s buddha logical passages, which tend to stress that a Buddha is defined above all by his knowledge of what is to be avoided and adopted by those intent on freedom, i.e., his knowledge of the four noble truths. The Buddha thus described is less notable for his transcendental nature than for his wise, compassionate, and skillful engagement with the world and its creatures---hence less obviously Mahāyānist than the Buddha described by those who articulate a “three-body” (trikāya) theory. I note by way of conclusion that, though Dharmakīrti’s buddhalogy did not prove as influential as his atheology, the juxtaposition of the two reveals an overall metaphysical consistency, in which axiomatic assumptions about permanence, impermanence, and deity are in harmony rather than tension. Technologies for human germ‐line modification may soon enable humanity to create new types of human beings. Decisions about use of this power entail an unprecedented combination of difficulties: the stakes are immense, the unknowns are daunting, and moral principles are called into question. Evolved morality is not a sure basis for these decisions, both because of its inherent imperfections and because genetic engineering could eventually change humans’ innate cognitive mechanisms. Nevertheless, consensus is needed on moral values relevant to germ‐line modification. (...) Grush and Churchland (1995) attempt to address aspects of the proposal that we have been making concerning a possible physical mechanism underlying the phenomenon of consciousness. Unfortunately, they employ arguments that are highly misleading and, in some important respects, factually incorrect. Their article ‘Gaps in Penrose’s Toilings’ is addressed specifically at the writings of one of us (Penrose), but since the particular model they attack is one put forward by both of us (Hameroff and Penrose, 1995; 1996), it is appropriate (...) that we both reply; but since our individual remarks refer to different aspects of their criticism we are commenting on their article separately. The logical arguments discussed by Grush and Churchland, and the related physics are answered in Part l by Penrose, largely by pointing out precisely where these arguments have already been treated in detail in Shadows of the Mind (Penrose, 1994). In Part 2, Hameroff replies to various points on the biological side, showing for example how they have seriously misunderstood what they refer to as ‘physiological evidence’ regarding to effects of the drug colchicine. The reply serves also to discuss aspects of our model ‘orchestrated objective reduction in brain microtubules – Orch OR’ which attempts to deal with the serious problems of consciousness more directly and completely than any previous theory. Idiopathic Parkinson’s disease impairs working memory, but the exact nature of this deficit in terms of the underlying cognitive mechanisms is not well understood. In this study patients with mild clinical symptoms of PD were compared with matched healthy control subjects on a computerized battery of tests designed to assess spatial working memory and verbal working memory. In the spatial working memory task, subjects were required to recall a sequence of four locations. The verbal working memory task was methodologically identical (...) except for the modality of the stimuli used, requiring subjects to orally recall a sequence of six digits. In either case, half of the sequences were structured in a way that allowed ‘chunking’, while others were unstructured. This manipulation was designed to dissociate the strategic component of task performance from the memory-load component. Mild medicated patients with PD were impaired only on the structured versions of the verbal working memory tasks. The analogous deficit in the spatial working memory was less pronounced. These findings are in agreement with the hypothesis that working memory deficits in PD reflect mainly the executive component of the tasks and that the deficits may be at least partly modality-independent. The format of this book is unusual, especially for a book about linguistics. The book is meant primarily as a research monograph aimed at linguists who have some background in formal semantics, e. g. Montague Grammar. However, I have two other audiences in mind. Linguists who have little or no experience of formal semantics, but who have worked through a basic mathematics for linguists course (e. g. using Wall, 1972, or Partee, 1978), should, perhaps with the help of a sympathetic (...) Montague gramma rian, be able to discover enough of how I have adapted some of the basic ideas in formal semantics to make the developments that I undertake in the rest of the book accessible. Logicians and computer scientists who know about model theoretic semantics and formal systems should be able to glean enough from Chapters I and II about linguistic concerns and techniques to be able to read the remainder of the book, again possibly with the help of a sympathetic Montague grammarian. However, readers should beware. Chapter II is not meant as a general introduction either to formal semantics or to linguistics and while much of the presentation there is going over ground that is already well covered in the literature, the particular formulation and the emphases are very much oriented to the developments to be undertaken later in the book. "Biodiversity prospecting" has been touted as a mechanism for both discovering new pharmaceutical products and saving endangered ecosystems. It is unclear what values may arise from such activities, however. Evidence from transactions is incomplete and existing theoretical models are flawed. We calculate an upper bound on the value of the "marginal species." Even under favorable assumptions this bound is modest. Slightly modified assumptions lead to drastically lower estimates. We extend our findings to the value of the marginal hectare of habitat (...) and find that the incentives for habitat conservation generated by private pharmaceutical research are also, at best, very modest. What is consciousness? Some philosophers have contended that ‘qualia’, or an experiential medium from which consciousness is derived, exists as a fundamental component of reality. Whitehead, for example, described the universe as being comprised of ‘occasions of experience’. To examine this possibility scientifically, the very nature of physical reality must be re-examined. We must come to terms with the physics of space-time -- as is described by Einstein's general theory of relativity -- and its relation to the fundamental theory of (...) matter -- as described by quantum theory. This leads us to employ a new physics of objective reduction: OR which appeals to a form of ‘quantum gravity’ to provide a useful description of fundamental processes at the quantum/classical borderline . Within the OR scheme, we consider that consciousness occurs if an appropriately organized system is able to develop and maintain quantum coherent superposition until a specific ‘objective’ criterion is reached; the coherent system then self-reduces . We contend that this type of objective self-collapse introduces non-computability, an essential feature of consciousness. OR is taken as an instantaneous event -- the climax of a self-organizing process in fundamental space-time -- and a candidate for a conscious Whitehead-like ‘occasion’ of experience. How could an OR process occur in the brain, be coupled to neural activities, and account for other features of consciousness? We nominate an OR process with the requisite characteristics to be occurring in cytoskeletal microtubules within the brain's neurons. (shrink)

Studies of the conceptual abilities of nonhuman primates demonstrate the substantial range of these abilities as well as their limitations. Such abilities range from categorization on the basis of shared physical attributes, associative relations and functions to abstract concepts as reflected in analogical reasoning about relations between relations. The pattern of results from these studies point to a fundamental distinction between monkeys and apes in both their implicit and explicit conceptual capacities. Monkeys, but not apes, might be best regarded as (...) “paleo‐logicans” in the sense that they form common class concepts of identity on the basis of identical predicates (i.e., shared features). The discrimination of presumably more abstract relations commonly involves relatively simple procedural strategies mediated by associative processes likely shared by all mammals. There is no evidence that monkeys can perceive, let alone judge, relations‐between‐relations. This analogical conceptual capacity is found only in chimpanzees and humans. Interestingly, the “analogical ape,” like the child, can make its analogical knowledge explicit only if it is first provided with a symbol system by which propositional representations can be encoded and manipulated. On Becoming an Effective Teacher presents the final unpublished writings of Rogers and as such has a unique historical value. In two studies, we explored the frequency and phenomenology of musical imagery. Study 1 used retrospective reports of musical imagery to assess the contribution of individual differences to imagery characteristics. Study 2 used an experience sampling design to assess the phenomenology of musical imagery over the course of one week in a sample of musicians and non-musicians. Both studies found episodes of musical imagery to be common and positive: people rarely wanted such experiences to end and often heard music that (...) was personally meaningful. Several variables predicted musical imagery, including personality, musical preferences, and positive mood. Musicians tended to hear musical imagery more often, but they reported less frequent episodes of deliberately-generated imagery. Taken together, the present research provides new insights into individual differences in musical imagery, and it supports the emerging view that such experiences are common, positive, and more voluntary than previously recognized.
